Seva Law Victory: Medical Rehabilitation v Qussar

Avatar for Nicolino Morana

Seva Law Firm wins appellate case in the Oakland Circuit Court.  In Medical Rehabilitation v Qussar, a medical facility sued its patient for medical bills despite the fact that the patient had two different insurances that covered the services.  The medical facility failed to bill and pursue the insurance company and, instead, decided to sue the patient.

The Seva Law Firm defended the patient in district court initially.  Unfortunately, the judge initially ruled that the patient was liable under an “account stated” theory.  The Seva Law Firm then appealed to the Oakland Circuit Court.  The Circuit Court appellate judge ruled that the district court was wrong and that the medical facility had not proven that it was owed any money from the patient.

Huge win for the good guys!
